These are the Terms and conditions of Gypsy Devine's (ABN 75182534439)("Gypsy Devine's", "we","us") located on our website at www.gypsydevine's.com, which is operated and owned by us.(Website). These Terms and Conditions also include our Terms of Use, Disclaimer and Privacy Policy on our website. Please read the said conditions thoroughly, as they apply to all transactions between us and can only be renownced or varied in writing, signed by us.
Australian Consumer Law: Our new goods come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure or faulty item. Vintage and preloved goods can be returned, refunded, replaced or issued with a store credit after proof of purchase, inspection and decision on those goods at the discretion of our staff.
eCommerce : While we take every care to ensure our online store is accurate and running up to date, unintentional mistakes may occur occasionally such as stock numbers availability or pricing differences on items.
Note : when you submit an order on our website, no agreement is formed until we process and accept your order and send you a confirmation. If we cannot fill your new stock order (such as when an item has sold out in the meantime) we will contact you to discuss your preference such as cancel that order, refund, replacement, store credit or wait for new stock delivery.
Privacy Policy
We collect and handle your personal information in accordance with the Privacy Act 1988 and Australian Privacy Principles. Your data will be securely stored , used only for specified purposes and shared only with your consent or as required by law.
Shipping Policy
Postage and Delivery.
We use standard Post Regular Parcel Service within Australia : from approx. sm. $11.15* to xlg. $23.30* approx. for orders under $100.
Free for orders over $100.(*Subject to change).
Regular orders dispatched within 1-2 business days but may take up to or over 4 days during busy periods (such as Christmas).
Regular Post parcels usually delivered within 3 - 7 days to metro areas and up to or over 10 days for regional areas. Remote areas may take longer.
We won't be liable for any consequential loss or damage or any other direct or indirect loss or damage , except where we are unable to limit or exclude such loss under the Australian Consumer Law. Where standard post does not service remote areas we will discuss with you the use of other delivery service providers and cost would be at your expense.
Payment, Refunds and Disclaimer
By placing an order you agree to make payment in full for that purchase including postage. You agree to pay the purchase price listed on the website.
We currently accept payment by Mastercard and Visa. If you fail to pay us for an order we may cancel delivery of that order and terminate this agreement.
Refunds
If you apply for a return and/or refund due to either faulty/damage in transit we must be notified and offer either a refund in full or a store credit or a replacement item, have the item repaired or pay for the item to be repaired. We will make a decision on the item. We must be notified of your intention to return within 14 days of delivery.
Intellectual Property
You acknowledge and agree that all intellectual property rights owned by us or to which we are entitled will remain our sole property and that nothing in this agreement transfers any ownership in our intellectual property to you.
